XIMO Terms and Conditions

Introduction

Welcome to XIMO. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and offerings. By accessing our site or purchasing any of our services, you agree to be bound by these Terms.

Services Provided

XIMO is a marketing agency based in Florida that offers:

  • Monthly Growth Campaigns (ad strategy, content creation, campaign management)

  • Social Media Management

  • One-Time Services (Photoshoots and Video Sessions for businesses)
     

Some services are available only in Orlando, FL and select areas in California. Content-related services may be performed by subcontractors or remote teams.

Payment Terms

  • Monthly services are billed in cycles (e.g., $700 every 15 days for the Monthly Growth Campaign, totaling $1400/month).

  • Ad spend is billed separately and directly by the advertising platform (Meta, TikTok, etc.). XIMO does not profit from ad spend and does not issue refunds on third-party platform charges.

  • One-time services require payment before delivering the finalized media.

  • All payments are final and non-refundable unless otherwise agreed in writing.

Project Scope and Client Responsibilities

  • Scope of services is defined per agreement or quote.

  • Clients are responsible for providing accurate business information, access to necessary digital platforms, and timely approvals.

  • Failure to provide necessary assets may delay deliverables or compromise results.

Content Rights & Usage

  • All visual content (photos/videos) created by XIMO remains the intellectual property of XIMO until full payment is received.

  • Upon payment, clients are granted a royalty-free, non-exclusive license to use deliverables for commercial purposes.

  • XIMO retains the right to showcase content in its portfolio and marketing materials unless the client requests otherwise in writing.

Cancellations & Termination

  • Monthly services require at least 7 days written notice before the next billing cycle to avoid charges.

  • If a project is terminated early, the client is responsible for payment of work completed up to the termination date.

Disclaimer of Guarantees

  • While XIMO uses proven strategies and best practices, we do not guarantee specific results such as revenue increases, follower growth, or conversions.

  • Performance depends on market conditions, client cooperation, and platform algorithms.

Limitation of Liability

  • XIMO shall not be liable for indirect, incidental, or consequential damages arising out of the use of our services.

  • Liability is limited to the amount paid by the client for services rendered within the past 30 days.

Governing Law

  • These Terms are governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved in the state or federal courts located in Orange County, Florida.

Changes to Terms

  • We may update these Terms at any time. Material changes will be posted on our website. Continued use of our services constitutes acceptance of the updated Terms.
